Wal-Mart sued by shopper over alleged slip and fall incident

GRETNA – A corporate retailer is being sued by a woman who claims she was injured after slipping and falling. 

Yasna Escobar filed suit against Wal-Mart Stores Inc., store #1342 in the 24th Judicial District Court.

Escobar asserts that on Oct. 18, 2013 she was a customer at Wal-Mart, located at 300 W. Esplanade Ave. in Kenner, when she was walking down a carpeted aisle and slipped and fell in a puddle of water. The plaintiff contends that she was injured as a result of the plaintiff’s negligence.

The defendant is accused of failing to maintain a safe place of business, failing to keep its aisle to code, allowing a danger to exist, failing to warn of unreasonable risks, failing to inspect and keep the presumes safe, failing to discover an unreasonably dangerous condition and creating a dangerous condition.

An unspecified amount in damages is sought for physical pain and suffering, mental anguish, aggravation, annoyance, disability, physical pain and suffering, mental anguish, medical expenses, loss of enjoyment of life, loss of function of parts of body, bodily disability, impairment of psychological functioning, disability from engaging in recreation, destruction of earning capacity, loss of support, loss of society and loss of consortium.

Escobar is represented by Robert B. Evans of New Orleans-based Burgos & Evans LLC.

The case has been assigned to Division K Judge Ellen Shirer Kovach.
